New York’s Scaffold Law Requires Workers be Given Proper Safety Gear

New York Labor Laws such as section 240(1), the “Scaffold Law”; section 241(6), the “Safe Place to Work Law”; and section 240 (negligence); require property owners, contractors and employers of construction workers to provide adequate safety protection to prevent construction accidents at the worksite. The Scaffold Law applies to any gravity-related accidents, such as a fall from heights. Employers are required to provide workers working at a height with personal fall arrest systems such as harnesses, to erect guardrails on scaffolds, or to take whatever safety measure is appropriate to the situation. Contractors should train workers on safety requirements for working on and around scaffolds, and a responsible person should inspect the scaffold for safety before the start of each shift.

Employers in violation of the scaffold law are absolutely liable to the injured worker for their medical costs, lost wages, pain and suffering, and other legal damages. As the injury victim, you only have to prove the injury and its cause; whether the employer was negligent or not is immaterial. A violation of the scaffold law in and of itself is a breach of the duty owed to the worker.
